March 2, 2026, wasn’t a good day for the transgender community.
Back in 2024, California approved the SAFETY Act to protect the privacy of transgender students by preventing schools from automatically notifying parents if a student changed their pronouns or gender expression.
But on March 2, the federal Supreme Court blocked it.
In the case of Mirabelli vs. Bonta, the Court issued a per curiam ruling (an unsigned decision usually reserved for urgent or non-controversial cases) siding with parents to keep schools from honoring the gender identity of their kids.
It is unclear why the court saw this as “non-controversial.”
Justices Kagan and Jackson felt the same, saying that the Court rushed to a judgment without full briefings or oral arguments, skipping the normal legal process entirely.
The argument from parents and teachers is that the SAFETY Act violated their 1st and 14th Amendment rights. Basically, it’s the same old song and dance of bigoted parents using the Constitution to justify their beliefs. The court majority agreed, stating these parents have a “sincere religious obligation” to raise their children according to their beliefs.
Who cares about the needs or rights of the kids, right?
This ruling is just keeping up with the trend of anti-LGBTQ+ attacks. On the surface, it’s another targeted hit, but it actually goes deeper.
By skipping the required legal steps, the Court basically let this win by default.
Because the amendments are written so broadly, they can be interpreted to fit any narrative, forcing us to choose between what is moral and what is lawful.
As Justice Elena Kagan wrote in her dissent: “Our normal processes . . . ensure that before the Court makes a decision, it has marshaled all the relevant facts . . . and deliberated internally.”
Basically, she’s saying the Court was wrong for skipping the rules just because the “majority” of justices wanted a quick decision.
For those who don’t know what it’s like to be transgender, imagine you live in the future where you can swap your brain into a different body. You pick a body that looks exactly like how you want to look, but the doctor accidentally puts you into the opposite gender. It can only be done once. When you wake up, something immediately feels wrong. You are 100% born with the knowledge of who you are, and it can’t be influenced or changed. Being transgender isn’t an “idea” or a “feeling”; it’s something you know.
Our justice system has always had bias, but they used to try to hide it. This is just out in the open now. How is that justice? Things can’t go on like this forever, but change only happens if we do something.
My advice? First, this case might still be ongoing; some reports suggest this is a temporary ban until it’s definitively settled. Nothing is final. Second, find a supportive place where you feel comfortable. TrevorSpace is a great resource with good counselors. If you’ve already come out to your teachers and you’re concerned about your parents finding out, talk to a trusted adult on campus to figure out the next steps.
Most importantly, don’t lie about who you are to yourself or anyone else. You are who you are. You’re born the way you are, and no matter what they tell you, that isn’t going to change.
